These terms and conditions shall replace any terms and conditions included with any purchase order, whether or not such terms and conditions are signed by Displaysignmart.com.

LIMIT OF LIABILITY

In no event shall DISPLAY SIGN MART, their officers, directors, employees, agents, vendors, suppliers or distributors, be liable for any incidental, indirect, special, accidental, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, profits or data, whether or not DISPLAY SIGN MART has been advised of the possibility of the damage, in connection with or arising out of the use or performance of this web site or of failure to provide services or products that you order from DISPLAY SIGN MART, or its affiliates, distributors, and agents , including without limitation, damages or loss arising from mistake, virus, delay, omission, or interruption of service. In no event shall DISPLAY SIGN MART be liable or responsible for any loss or damages or consequences arising from or related to your inappropriate or unauthorized use of this web site and its content.

LIMITATION OF LIABILITY as to PRODUCTS SOLD

Unless is stated herein, DISPLAY SIGN MART makes no representations or warranties, either express or implied, of any kind with respect to products sold at the DISPLAYSIGNMART.COM sites. Unless as expressly stated herein, DISPLAYSIGNMART expressly disclaims all warranties, express or implied, of any kind with respect to products sold at this DISPLAYSIGNMART.com web sites. You agree that the only and exclusive maximum liability to DISPLAYSIGNMART arising from any product sold on DISPLAYSIGNMART.com web sites shall be the price of the product ordered. In no event shall DISPLAYSIGNMART, its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related into product sold.

ERRORS & OMISSION

DISPLAYSIGNMART try our best to be as accurate as possible. However, we cannot guarantee that all product descriptions or other content of this web site is accurate, current, reliable, complete or free of error. If a product offered by us is not as described, your only remedy is to return it in unused condition and complete packaging.

In the event a product is listed with incorrect price or with incorrect information due to typographical error in pricing or product information received from suppliers, DISPLAY SIGN MART shall have the right to refuse or cancel any orders placed for product listed at incorrect price or information. We, DISPLAY SIGN MART also have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card is charged. If your credit card has been charged for the purchase and your order is cancelled by us, we shall immediately issue a credit back to your credit card account in the amount of the charge.

RETURNS or REFUNDS

Any compensation or refunds of cancellation order given to the customer will be refunded in a timely manner. Please allow 15 – 25 business days for the monies to be credited to your account.

Customer must notify or file a claim to DISPLAY SIGN MART within 3 business days of order acceptance to notify any defects or mistakes discovered in the ordered products or the claim will be denied. In order to receive replacement of product, customer must return 100% of the received product within 10 business days (at customer’s own expense) from the time when the ordered was received by the customer. If return for replacement is accepted, a RMA (Return Merchandise Authorization) number will be issued and replacement will be mailed within 30 days provided we have that item in stock.

All charges related to expedite the service (rush printing or shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason.

All returns must include original packaging. Do not cut out the UPC code, if there is any, or throw away the packing materials until you have examined and tested the product to your satisfaction. Removal of the UPC code and also return without full packaging will NOT be accepted regardless of RMA or credit request status. Original Packing List and Original Invoice have to be sent back to us with the return product. We do not accept any return without the Original Packing List and Original Invoice. Return must be completed with all accessories for that product including manuals, warranty cards, registration information, etc.

DISPLAYSIGNMART in its sole and absoulte discretion shall be the sole determiner of whether a product is in fact defective.

UNDELIVERED PACKAGE

If the address you provided is undeliverable, we may contact you to verify your address for re-shipment. However, you should responsible for the additional shipping charges, any taxes, duties, or customs charges that are incurred on the package for both the original and the re-delivered shipment.

TRANSFER OF TITLE

Our shipping terms are FOB Shipping Point, which means ownership transfers once we deliver any products to DISPLAY SIGN MART’s shipping carrier. Any loss or damage that occurs during shipment by a carrier selected by either customer or by us is customer's responsibility and customer should contact that freight carrier for claims of loss or damage.

INDEMNITY

You agree that you shall indemnify and defend DISPLAY SIGN MART and all parties from whom DISPLAY SIGN MART has licensed portions of content, and their officers, directors, and employees, against all claims, loss, damages, liability and costs and expenses, including reasonable legal fees and expenses arising out of or related to (1) your breach of these Terms and Conditions or (2) any claim, suit, loss or demand arising from or relating to any photograph, image, graphic, text or content or other material you incorporated into the products.

ORDER APPROVAL & SUBMITTED

Please review your order prior to submitting to us. We, DISPLAY SIGN MART will not accept changes to orders that have been placed. We apologize for any inconvenience we may have caused. Customer is fully responsible for final proof and layout approval prior to the printing process. And customer has to check their orders before submitting to us.

DISPLAY SIGN MART is NOT LIABLE for errors in a final product caused by any of the followings: Graphic, Bleeds, Grammar, Misspelling, Damage Fonts, Punctuation, Incorrect or Missing Folds, Crop Marks, Overprint, Finished Product Size. We do NOT make any changes on our customer’s files.

INDEMNITY

By submitting the above order or files to DISPLAY SIGN MART, I agree to the following terms: I have verified that spelling and contents are correct. I understand that my document or banner will print EXACTLY as it appears as the document or files submitted, that I cannot make any changes once my order is placed and that I assume all responsibility for typo or graphical errors.

CUSTOMER SUBMITTED ARTWORK OR GRAPHICS

All artwork or designs and images must be provided in CMYK format. DISPLAY SIGN MART is NOT responsible for any color shift that occurs in converting RGB to CMYK or PMS Pantone colors to CMYK color modes.

All artwork, designs and images must be provided in the minimum of 300 DPI and CMYK mode as well. DISPLAY SIGN MART is not responsible for images printed as fuzzy, blur, distorted, or pixilated due to customer provided artwork.

We, DISPLAY SIGN MART is not responsible for any color shift in converted pictures (RGB images) with black, near black, or gray tones, Color shifts from a perceived black, or gray must be corrected or addressed prior to file submission. Proofs do not guarantee black, near black, or gray final output.

RE-ORDERS

We, DISPLAY SIGN MART will not keep any job orders in our systems after print. Due to this limitation, customer needs to re-submit all files and submit new order even if they need to re-order.

ORDER SHIPPING

DISPLAY SIGN MART will always try to make sure that any production problems do not delay delivery schedules. In no case shall DISPLAY SIGN MART be liable for any damages or loss or consequential resulting from any delay in shipment or delivery. All DISPLAY SIGN MART customers agree not to hold us liable for delays in shipments caused by shipping company delays, weather conditions, international customs issues or any other circumstances beyond DISPLAY SIGN MART’s direct control. We, DISPLAY SIGN MART always act to make sure that delivery schedules are met. However, unexpected circumstances such as malfunction, or technical problems and equipment failure may delay the printing process. In case of delay caused by these technical problem, rush charges or fees will be refunded or waived where applicable. However, technical problems or equipment failure will not be the grounds for order cancellation.

DISPLAY SIGN MART will only use our own shipping account and will NOT use customer provided account numbers for any couriers. Please note that we do NOT ship to P.O. Boxes.

When a package is NOT delivered due to an error made by the customer in submitting the proper shipping address when order is place, DISPLAY SIGN MART will reship the package with corrected address and charge an additional shipping charge for that shipment.

SHIPPING ERRORS & LOST

Damaged or lost claims can only be filed for shipments over $50 in value and can only be done after 30 days from package shipment. We, DISPLAY SIGN MART is NOT responsible for 3rd party shipping errors, damaged or omissions shipments.

Return Merchandise Authorization (RMA) Policy:

DISPLAY SIGN MART guarantees our prints will not be defective in accordance with the industry standards. However, if a print is found to be defective some how, then you should contact us for a reprint or other compensation. DISPLAY SIGN MART must be contacted IN WRITING via support system with 3 business days of receiving your order. If product is found to be defective, one of the followings will be offered:

DISPLAY SIGN MART will reprint the order with rush production.

DISPLAY SIGN MART will authorize a Return Merchandise Authorization (RMA) number to you. A quality Assurance representative from our company will contact you within 36-48 hours of your initial query to help issue your RMA number. Contact with our representative must be done within 3 business days to verify the request. DISPLAY SIGN MART must receive the return package within 15 calendar days after our RMA number is issued. Compensation will be processed only after a RMA number has been issued and the entire product has been returned to us then the refund transaction will take place within 15 business days. Samples of the defective merchandise must be required prior to any resolution.

CUSTOMER CONTENT

You should understand that all information, data, photographs, messages, graphics, text or other materials are the sole responsibility of the person from which such CONTENT originated. This means that you, or your company, and NOT DISPLAY SIGN MART are entirely responsible for all content that you use for DISPLAY SIGN MART or send, post, unload, or transmit via the Service. In recognizing the global nature of Internet, you agree to comply with all local rules regarding online conduct, regulation, and acceptable Content. You agree NOT to use the Service to upload, send, post or transmit any Content that contains (1) a threat to injure any personal property, reputation, or a threat to black mail; (2) child pornography or anything obscene, lewd, filthy, lascivious, and indecent; (3) any forcible resistance to any law of the United States; (4) any content that infringes the intellectual property rights or quality of the Content Under no circumstances will DISPLAY SIGN MART be responsible in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising.

You should acknowledge that DISPLAY SIGN MART does not pre-screen CONTENT, but that DISPLAY SIGN MART and its affiliates shall have the right; but NOT the obligation in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. Your further acknowledge and agree that DISPLAY SIGN MART may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to (1) enforce the terms of service; (2) respond to claims that the Content violates the rights of third-parties; (3) comply with legal process; (4) protect the rights, personal safety or property of DISPLAY SIGN MART, the public and its users.
